Terms of Use for Subscription-Based Template & Price List Service

TERMS OF USE

Effective Date: November 24, 2025


1. Introduction

These Terms of Use (“Terms”) govern your access to and use of Campbells Estimating Services Pty Ltd’s subscription-based template and price list service (“Service”). By subscribing, you agree to comply with these Terms, our [Privacy Policy] and [Terms & Conditions], which apply upon payment.


2. Scope of Service

  • The Service provides access to estimating templates, price lists, and related resources for construction projects.
  • Templates and price lists are for business use only and may not be resold, redistributed, or shared outside your organization without written consent.
  • Copying, sharing, or redistributing templates or price lists will result in legal action and compensation for losses.
  • We may update templates and price lists periodically. Updates will be communicated via email or platform notifications.


3. Subscription & Payment
  • Monthly Plan: Subscriptions billed monthly are subject to a minimum 12-month contract. Regardless of usage, the full 12 months must be paid before cancellation or non-renewal.
  • Annual Plan: Annual subscriptions are billed upfront and cover 12 months of access.
  • All fees are in Australian Dollars and include GST unless stated otherwise.
  • Failure to pay may result in suspension or termination of access.


4. Cancellation & Renewal
  • Subscriptions can be cancelled through the Campbells Estimating Members Portal.
  • Cancellation will prevent renewal after the current term ends but does not waive payment obligations for the full 12-month term.
  • No refunds or partial refunds will be issued for unused time.


5. Platform Dependency & Downtime Disclaimer
  • Our services are hosted within third-party platforms (e.g., cloud-based systems, CRM tools).
  • We do not control the availability, performance, or functionality of these platforms.
  • If any third-party platform experiences technical issues, outages, or downtime, this is outside our control.
  • No refunds or partial refunds will be issued for any period of service disruption caused by third-party platform issues.


6. Intellectual Property
  • All templates, price lists, and related materials are protected by copyright and remain the property of Campbells Estimating Services Pty Ltd.
  • You are granted a non-exclusive, non-transferable license to use the materials for your internal business purposes only.
  • You may not copy, modify, distribute, or create derivative works without prior written consent.


7. User Responsibilities
  • Ensure your account credentials remain confidential.
  • Do not use the Service for unlawful purposes or in violation of applicable laws.
  • You are responsible for verifying the accuracy of any estimates generated using our templates and price lists.


8. Data & Privacy
  • We collect and process personal data in accordance with our [Privacy Policy].
  • By using the Service, you consent to such collection and processing.


9. Limitation of Liability
  • The Service is provided “as is.” We do not guarantee that templates or price lists will result in successful tenders or projects.
  • To the fullest extent permitted by law, we disclaim liability for indirect or consequential losses, including loss of profit or business opportunity.


10. Governing Law

These Terms are governed by the laws of Queensland, Australia.
